This non-free media file has been set up with as small a version as possible, to comply with Wikipedia's non-free content policy and United States copyright law. The current resolution has been manually selected to achieve as small an image as possible without destroying the image content. According to Wikipedia's policy for non-free content, the amount of non-free work should be as little as possible. In particular, non-free media on Wikipedia should not be usable as substitutes for the original work.

Summary

[edit]

This software is copyrighted, but its screenshot is being used here under U.S. fair use laws, because:

  • it helps to visually identify a specific visual component of the software; without visual identification, the effect is impossible to be communicated. In that sense it furthers the goal of providing verifiable information.
  • it does not limit, nor does it claim to, limit the rights of the copyright holder.
  • it does not, in any way, assist in illegal reproduction of the software or any other things covered by the license of the software.
  • it is being used for informational purposes.
  • it is copyrighted, so free equivalent cannot exist.

The rationale applies to the usage in NTFS as a method of illustrating the ACLs used by NTFS for Windows NT permissions, adjacent to the text. By definition, there is no free replacement for its use here.

Licensing

[edit]

Microsoft product screenshot, used with permission from Microsoft.

This image is a copyrighted screenshot of a commercially released computer software product owned by Microsoft Corporation. Microsoft Corporation allows screenshots of its commercially released computer software products for use in advertising, documentations, educational materials, videos and web sites as long as they are not obscene or pornographic, are not disparaging, defamatory, or libelous to Microsoft, and are not digitally altered (except for being resized).

However, the use of this screenshot in Wikipedia must comply with Wikipedia's non-free content criteria policy, because the license forbids derivative works. Images that do not comply may be nominated for deletion.

Use of Microsoft copyrighted content
Requirements for allowed uses
For permission to be granted by Microsoft for any uses allowed by these guidelines, you must comply with the following four requirements:
  1. If your use includes references to a Microsoft product, you must use the full name of the product. When referencing any Microsoft trademarks, follow the General Microsoft Trademark Guidelines.
  2. You may link to content from Microsoft by using either a plain text link with words such as "This way to Microsoft.com" or by participating in an applicable Link Logo program. No other images may be used as a link to a Microsoft site.
  3. You must include this following statement: "Used with permission from Microsoft."
  4. Your use may not be obscene or pornographic, and you may not be disparaging, defamatory, or libelous to Microsoft, any of its products, or any other person or entity.
Screenshots
If you wish to benefit from Microsoft's automatic permission grant, you may not use screenshots of Microsoft product boot-up screens, opening screens, "splash screens", or screens from beta release products or other products that have not been commercially released. You may use other screenshots in advertising, in documentation (including educational brochures), in tutorial books, in videotapes, or on Web sites, provided that, in addition to the requirements above, you:
  1. Do not alter the screenshot except to resize it.
  2. Do not use portions of screenshots.
  3. Do not include screenshots in your product user interface.
  4. Do not use screenshots that contain third-party content.
  5. Do not use screenshots that contain an image of an identifiable individual.

Aside from the claim that this file qualifies for use without permission under fair use, this file is also available under a license that permits unrestricted redistribution in unaltered form but forbids derivative works. Files available under such terms do not meet the definition of Free Cultural Works as adopted by the Wikimedia Foundation, and are therefore considered non-free on Wikipedia and may only be used under Wikipedia's non-free content policy.
This tag must only be used with a non-free license tag and a valid fair use rationale as required by policy.
