Please advise, is the underlined part clear? I want to say that sanctions are possible (are not excluded)

Context: memorandum in which a law firm recommends that a kindergarten requests the Ministry to be included in the network of pre-schools and schools (to be a network kinderkarten) otherwise there can be problems
"Alternatively, it is possible to operate a so-called non-network kindergarten as described below, whereby we would recommend registration for compulsory pre-primary education by 2028. At present, we know that such non-network kindergartens exist and operate properly alongside kindergartens included in the network. However, as this is an unregulated area, that the operation of a non-network kindergarten, within the scope of a kindergarten included in the network,by the competent authorities in the future."
