Hello! I would like to know whether "gateway issue" is some sort of idiomatic expression and what the meaning could be in the following context:

Many lawsuits in agency law test the gateway issue of whether an interaction between two people has created an agency relationship.

Law School for Everyone: Corporate Law (George Greis). However, I highly doubt it is a technical term in law; in fact, as the aim of these texts is to help beginners, they don't usually include any technical terms that they haven't explained before.
The gateway that must be got through to continue the case.

If there is no agency relationship, there can be no case in agency law. (That's based solely on the meaning of the words provided. I am not a lawyer, so I am as informed as the intended audience of the book.)

If the gateway test is not passed, the gate remains shut.
