IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT USE THE SOFTWARE. IF YOU DO NOT AGREE TO THE TERMS OF THE LICENSE,CLICK "DISAGREE" OR DON’T INSTALL THE SOFTWARE.
IMPORTANT NOTE: To the extent that the software might be used to acquire or reproduce materials, it is licensed to you only for acquiring or reproduction of non-copyrighted materials, materials to which you own the copyright, or materials you are authorized or legally permitted to acquire or reproduce, and only for personal and non-commercial use. 1. General.
The Company developed a unique browser that enables and provides users with a more private, secured, personalized and customized browsing experience. UR browser embeds many features and value-added services, including but not limited to, third party web services and extension (such as adblock, media features, etc.) customized home page, customized backgrounds shortcuts and link to favorite sites, media player, free games and news feeds, etc., (collectively referred herein as the “Service(S)”). We may use third party services, feeds, APIs and licenses that may require you to accept additional terms or register, sign in or create an account. None of the features are mandatory and you may choose which features you wish to add to the Browser and which you prefer to opt-out.
The ADAPTIVEBEE and any third party software, documentation and any fonts accompanying this License whether on disk, in read only memory, on any other media or in any other form (collectively the "ADAPTIVEBEE Software") are licensed, not sold, to you by ADAPTIVEBEE S.A.S.U. ("ADAPTIVEBEE") for use only under the terms of this License. ADAPTIVEBEE and/or its licensors retain ownership of the ADAPTIVEBEE Software itself and reserves all rights not expressly granted to you. The terms of this License will govern any software upgrades provided by ADAPTIVEBEE that replace and/or supplement the original ADAPTIVEBEE Software product, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern. Title and intellectual property rights in and to any content displayed by or accessed through the ADAPTIVEBEE Software belongs to the respective content owner. Such content may be protected by copyright or other intellectual property laws and treaties, and may be subject to terms of use of the third party providing such content. This License does not grant you any rights to use such content.
ADAPTIVEBEE reserves the right, at its sole discretion, to modify this license, at any time and without prior notice. If we modify this license, we will post the modifications on a website owned by ADAPTIVEBEE or provide you with notice of the modification. We will also update the “Last modified” date at the top of the home page of this document. By continuing to access or use the ADAPTIVEBEE Software after we have posted a modification on a website owned by ADAPTIVEBEE or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified license. If the modified license is not acceptable to you, your only recourse is to cease using the ADAPTIVEBEE software.

2. Permitted License Uses and Restrictions.
A) Subject to the terms and conditions of this License you are granted a limited non-exclusive license to install and use one copy of the ADAPTIVEBEE Software on each computer owned or controlled by you. To the extent that the ADAPTIVEBEE Software may be used to reproduce materials, such use is limited to reproduction of non copyrighted materials, materials in which you own the copyright, or materials you are authorized or legally permitted to reproduce. This License does not allow the ADAPTIVEBEE Software to exist on more than one computer at a time, and you may not make the ADAPTIVEBEE Software available over a network where it could be used by multiple computers at the same time. You may make one copy of the ADAPTIVEBEE Software in machine-readable form for backup purposes only; provided that the backup copy must include all copyright or other proprietary notices contained on the original. In addition to the restrictions stated above, the ADAPTIVEBEE proprietary features and extensions included with the ADAPTIVEBEE Software are only licensed for use with the ADAPTIVEBEE Software . You may not use the ADAPTIVEBEE features and extensions for any other purpose, nor may you link, compile or otherwise combine the ADAPTIVEBEE features and extensions with your own programs, modify, rent, release, lend, sublicense or otherwise redistribute the ADAPTIVEBEE features and extensions, in whole or in part.
B) By accepting this licenses agreement you are allowed to use Adaptivbee's services, including UR browser's VPN, only if you are legally capacitated and authorized to conclude an agreement with Adaptivebee and such conclusion is not forbidden to you according to the applicable laws. You hereby represent and warrant that you will use the Adaptivebee services, including UR VPN or the Service solely for privacy and security needs and in full compliance with all applicable local, state, national, and international laws, rules and regulations. You shall not agree to, nor shall you authorize or encourage any third party to: (i) prevent others from using the Adaptivebee services; (ii) use the Adaptivebee services for any fraudulent or inappropriate or illegal purpose (i.e., cyber activity); or (iii) act in any way that violates this Agreement. Adaptivebee's VPN services should provide you with the possibility to perform internet traffic using a computer in various regions and to keep your IP address hidden. Your data traffic is thus encoded and cannot be spied out. The goal of Adaptivebee's VPN services is to protect your privacy but not your computer. Adaptivebee's services are not meant as an antivirus or anti-malware tool.
C) ADAPTIVEBEE Software incorporates certain open source third-party software and code, which are licensed to you and subject to the license provisions of such providers. Therefore, you may use a source code version of certain ADAPTIVEBEE Software functionality and distribution free of charge under these public licenses. These licenses permit you to run, copy, modify, and/or redistribute the open-source components subject to certain restrictions described in the terms of these licenses which you should review. This License does not limit your rights under, or grant you rights that supersede, the license terms of any particular open source component of the ADAPTIVEBEE Software. The extent that any of the terms set out herein conflict with any terms contained in the third party open source license, the conflicting terms will not apply to the third party open source code. This License will also govern any ADAPTIVEBEE Software upgrades provided by ADAPTIVEBEE that replace and/or supplement the original product, unless such upgrades are accompanied by a separate license, in which case the terms of that license will govern.

D) You may not and you agree not to, or to enable others to, copy except as expressly permitted by this License, attempt to derive the source code of, decrypt, modify, create derivative works of the ADAPTIVEBEE Software, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by licensing terms governing use of open-sourced components included with the ADAPTIVEBEE Software). Any attempt to do so is a violation of the rights of ADAPTIVEBEE and its licensors of the ADAPTIVEBEE Software. ADAPTIVEBEE does not own FFmpeg (https://ffmpeg.org).
3. Transfer.
You may not rent, lease, lend, sell, redistribute or sublicense the ADAPTIVEBEE Software. You may, however, make a one-time permanent transfer of all of your license rights to the ADAPTIVEBEE Software to another party, provided that: (a) the transfer must include all of the ADAPTIVEBEE Software, including all its component parts, original media (if any), printed materials and this License; (b) you do not retain any copies of the ADAPTIVEBEE Software, full or partial, including copies stored on a computer or other storage device; and (c) the party receiving the ADAPTIVEBEE Software reads and agrees to accept the terms and conditions of this License. All components of the ADAPTIVEBEE Software are provided as part of a bundle and may not be separated from the bundle and distributed as standalone applications. Updates: If an ADAPTIVEBEE Software update completely replaces (full install) a previously licensed version of the ADAPTIVEBEE Software, you may not use both versions of the ADAPTIVEBEE Software at the same time nor may you transfer them separately.
4. Consent to Use of Data.
A) Diagnostic Usage Data. You agree that ADAPTIVEBEE may collect, maintain, process and use diagnostic, technical usage and related anonymous information including, but not limited to, information about your computer, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the ADAPTIVEBEE Software, and to verify compliance with the terms of this License. ADAPTIVEBEE may use this information, as long as it is collected anonymously in a form that does not personally identify you, to provide and improve ADAPTIVEBEE’s products and services..
B) Bookmarks and local data. By installing UR Browser you may consent to locally import bookmarks, history, saved passwords and cookies from other browsers at the moment of using this browsers’ specific features.
C) For information about ADAPTIVEBEE Software data protection practices, please read UR Browser’s privacy policy at http://www.ur-browser.com/privacy-policy. This policy explains how ADAPTIVEBEE treats your personal information, and protects your privacy, when you use the ADAPTIVEBEE Software.
D) You agree to the use of your data in accordance with the privacy policy of ADAPTIVEBEE Software.
5. Software updates.
The ADAPTIVEBEE Software which you use may automatically download and install updates from time to time from ADAPTIVEBEE. These updates are designed to improve, enhance and further develop the ADAPTIVEBEE Software and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. You agree to receive such updates (and permit ADAPTIVEBEE to deliver these to you) as part of your use of the ADAPTIVEBEE Software. These updates may occur all at once or over multiple sessions and require your review and acceptance of our then-current License before you will be permitted to use any subsequent versions of the ADAPTIVEBEE Software. You acknowledge and agree that ADAPTIVEBEE has no obligation to make available to you any subsequent versions of the ADAPTIVEBEE Software. You are not obligated to use any of the features of the ADAPTIVEBEE Software including, but not limited to content and news feeds.
6. Termination.
This License is effective until terminated. Your rights under this License will terminate automatically or otherwise cease to be effective without notice from ADAPTIVEBEE if you fail to comply with any term(s) of this License. At any time, you may stop using the UR browser by uninstalling the browser or disabling the Services. We reserve the right, at any time, to: (i) discontinue, terminate, suspend or modify any aspect of the Service; or (ii) terminate these Terms and your use of the Service with or without cause, and we shall not be liable to you or any third party for any of the foregoing. The Company does not assume any responsibility with respect to, or in connection with, the termination of the Service or these Terms. These Terms will automatically terminate if you fail to comply with any of its requirements. Upon any termination, you agree to stop using the Service, exit and remove the UR browser from your device.
You acknowledge that: (i) your access to and use of the UR browser may be suspended for the duration of any unanticipated or unscheduled downtime or unavailability of any portion or all of the Services for any reason, including as a result of power outages, system failures or other interruptions; and (ii) we shall also be entitled, without any liability to you, to suspend access to any portion or all of the UR browser or Services at any time (a) for scheduled downtime to permit us to conduct maintenance or make modifications to any of the UR browser or Services; or (b) in the event that we determine that any of the Services are prohibited by law or we otherwise determine that it is necessary or prudent to do so for legal or regulatory reasons (collectively, "Services Interruptions").
The availability and functionality of the UR browser depends on various factors, including software, hardware and communication networks that are provided by third parties. These factors are not fault free. The Company does not warrant that the UR browse will operate without disruption, errors or interruptions, or that it will be accessible, or available at all times or be immune from errors or unauthorized access. We reserve the right to add additional features to the UR Browser or to provide updates, upgrades or programming fixes; we have no obligation to make available to you any subsequent versions of the UR browser.
Upon the termination of this License, you shall cease all use of the ADAPTIVEBEE Software and destroy all copies, full or partial, of the ADAPTIVEBEE Software. Sections 4, 5, 6, 7, 8, 11 and 12 of this License survive any such termination.
7. Services and Third Party Materials.
A) The ADAPTIVEBEE Software automatically references, displays, and links to, third party web sites and information located worldwide throughout the Internet, and the ADAPTIVEBEE Software also performs or provides access to ADAPTIVEBEE and third party web services as well as third party extensions (collectively and individually, “Services”). Use of the Services requires Internet access and use of certain Services may require you to accept additional terms.
B) By installing and/or updating the ADAPTIVEBEE Software you acknowledge and agree that the ADAPTIVEBEE Software may be set as your default browser as a result of your explicit consent and that desktop shortcuts to search and UR Browser will be created in order to provide easy access to supported features.
You can change this at any time following the installation and set any other application as your default browser by using the settings available in the Internet browsers installed on your system or via the controls available in your operating system.
C) You agree that ADAPTIVEBEE may modify the default search provider of the UR Browser during your use of the product. If you do not want to have your default search provider modified, you may refuse the modification as part of the ADAPTIVEBEE Software installation process or, after installation, you may deactivate the modification of your search properties by accessing the ADAPTIVEBEE’s Software’s menu “Tools > Settings" and selecting the desired “Search” option.
D) By installing UR Browser on your computer, you consent to the association of the search settings to our third party affiliate partners and their Terms of Service: oscobo, lilo, bing, oath;
E) In order to make Adaptivebee's UR VPN service available, Adaptivebee cooperates with third party providers (such as, Stripe for payment operations or Data Processing Centers, OVPN for our VPN services). If you want to find out more about the third party providers, with whom Adaptivebee cooperates, please read our Privacy Policy. Thus, you award Adaptivebee the necessary approvals to process there safely your encoded data and/ or your encoded data traffic.
F) We make best efforts to monitor and choose our partners and secure the services provided to you. WE DISCLAIM ALL REPRESENTATIONS AND WARRANTIES REGARDING CONTENT, GOODS, SOFTWARE OR SERVICES YOU OBTAIN FROM THIRD PARTY PROVIDERS.
G) You understand that by using the ADAPTIVEBEE Software or any of the Services, you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use the ADAPTIVEBEE Software and Services at your sole risk and that ADAPTIVEBEE shall have no liability to you for content that may be found to be offensive, indecent, or objectionable.
H) By using the ADAPTIVEBEE Software and Services, you acknowledge and agree that ADAPTIVEBEE is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of third party materials, extensions or web sites. ADAPTIVEBEE, its officers, affiliates and subsidiaries do not warrant or endorse and do not assume and will not have any liability or responsibility to you or any other person for any third-party Services, third party materials, extensions or web sites, or for any other materials, products, or services of third parties. Third party materials and extensions and links to third party web sites are provided solely as a convenience to you.
I) Financial information displayed by the ADAPTIVEBEE Software or any Services is for general informational purposes only and should not be relied upon as investment advice. Before executing any securities transaction based upon information obtained through the ADAPTIVEBEE Software or Services, you should consult with a financial or securities professional who is legally qualified to give financial or securities advice in your country or region. Location data provided by the ADAPTIVEBEE Software or any Services is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate, time-delayed or incomplete location data may lead to death, personal injury, property or environmental damage. Neither ADAPTIVEBEE nor any of its content providers guarantees the availability, accuracy, completeness, reliability, or timeliness of stock information, location data or any other data displayed by the ADAPTIVEBEE Software or any Services.
J) You agree that the Services contain proprietary content, information and material that is owned by ADAPTIVEBEE and/or its licensors, and is protected by applicable intellectual property and other laws including, but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services or in any manner that is inconsistent with the terms of this License or that infringes any intellectual property rights of a third party or ADAPTIVEBEE. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you shall not exploit the Services in any unauthorized way whatsoever including, but not limited to, using the Services to transmit any computer viruses, worms, trojan horses or other malware, or by trespass or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that ADAPTIVEBEE is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive, infringing or illegal messages or transmissions that you may receive as a result of using any of the Services.
K) ADAPTIVEBEE and its licensors reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will ADAPTIVEBEE be liable for the removal of or disabling of access to any such Services. ADAPTIVEBEE may also impose limits on the use of or access to certain Services, in any case and without notice or liability.
8. Disclaimer of Warranties.
A) If you are a customer who is a consumer (someone who uses the ADAPTIVEBEE Software outside of your trade, business or profession), you may have legal rights in your country of residence which would prohibit the following limitations from applying to you, and where prohibited they will not apply to you. To find out more about rights, you should contact a local consumer advice organization.
B) YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE ADAPTIVEBEE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU.
C) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ADAPTIVEBEE SOFTWARE AND ANY ADAPTIVEBEE OR THIRD PARTY SERVICES PERFORMED OR PROVIDED BY THE ADAPTIVEBEE SOFTWARE (COLLECTIVELY "SERVICES") ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND ADAPTIVEBEE AND ADAPTIVEBEE 'S LICENSORS (COLLECTIVELY REFERRED TO AS “ADAPTIVEBEE” FOR THE PURPOSES OF SECTIONS 7 and 8) HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE ADAPTIVEBEE SOFTWARE AND SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.
D) ADAPTIVEBEE DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE ADAPTIVEBEE SOFTWARE AND SERVICES, THAT THE FUNCTIONS CONTAINED IN, OR SERVICES PERFORMED OR PROVIDED BY, THE ADAPTIVEBEE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE ADAPTIVEBEE SOFTWARE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY SERVICE WILL CONTINUE TO BE MADE AVAILABLE, THAT THE ADAPTIVEBEE SOFTWARE OR SERVICES WILL BE COMPATIBLE WITH THIRD PARTY SOFTWARE OR OTHER THIRD PARTY SERVICES, OR THAT DEFECTS IN THE ADAPTIVEBEE SOFTWARE OR SERVICES WILL BE CORRECTED.
E) YOU FURTHER ACKNOWLEDGE THAT THE ADAPTIVEBEE SOFTWARE AND SERVICES ARE NOT INTENDED OR SUITABLE FOR USE IN SITUATIONS OR ENVIRONMENTS WHERE THE FAILURE OR TIME DELAYS OF, OR ERRORS OR INACCURACIES IN THE CONTENT, DATA OR INFORMATION PROVIDED BY, THE ADAPTIVEBEE SOFTWARE OR SERVICES COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE, INCLUDING WITHOUT LIMITATION THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, LIFE SUPPORT OR WEAPONS SYSTEMS.
F) NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY ADAPTIVEBEE OR AN ADAPTIVEBEE AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE ADAPTIVEBEE SOFTWARE OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
9. Limitation of Liability.
TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT SHALL ADAPTIVEBEE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, FAILURE TO TRANSMIT OR RECEIVE ANY DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE ADAPTIVEBEE SOFTWARE AND SERVICES OR ANY THIRD PARTY SOFTWARE OR APPLICATIONS IN CONJUNCTION WITH THE ADAPTIVEBEE SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF ADAPTIVEBEE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall ADAPTIVEBEE's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
10. Export Control.
You agree to comply fully with all of France’s export laws and regulations to ensure that neither the ADAPTIVEBEE Software nor any technical data related thereto nor any direct product thereof are exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations.
11. Copyright & IP Policy.
ADAPTIVEBEE respects copyright law and expects its users to do the same. ADAPTIVEBEE has implemented policies and dedicated resources to act efficiently in matters of copyright. If you believe that a work residing in UR Browser infringes a copyright, please send us a notice of copyright infringement to our e-mail address (contact@adaptivebee.com) and we will address the matter as soon as possible.
You must include the following information in your notice: (a) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) identification of the copyrighted work claimed to have been infringed; (c) a description of the nature and exact location of the content that you claim to infringe your copyright, in sufficient detail so to allow ADAPTIVEBEE to locate and identify such content; (d) your name, address and email address; (e) a statement that you have a good faith belief that the use of the material in the manner described in your notice is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notice is accurate, and that you are either the copyright owner or a person authorized to act on their behalf.
12. Payment.
A) Adaptivebee does not store data within UR browser VPN which could permit interference with your personal data. B) Payments are always done in advance for Adaptivebee's services. If outside the EU, no VAT is charged.
C) Subscription periods: Adaptivebee offers three different subscription lengths. 1 month (31 days), 3 months (93 days) and 1 year (366 days). The contract between Adaptivebee SASU and the customer runs as long as the subscription length.
D) Personal subscription: Subscriptions are personal and may not be transferred or used by other people. If multiple users use the same account it will be suspended immediately with no refund options, as it's considered a direct violation of this agreement.
E) Refund policy: Adaptivebee has a 10-day money-back guarantee for first-time purchases. In accordance with French law under which Adaptivebee operates, we reserve the right to refuse refunds of renewal purchases. The customer must contact Adaptivebee within 10 days of making the first payment by email or live chat for the money-back guarantee to be valid. Please consider, even if unusually so, refunds may take up to 30 days in processing until your account is refunded.
F) Renewal of subscriptions: Subscriptions renew automatically when payment was done. All our offers include an automatic subscription renewal. The customer can, at any point, deactivate automatic renewal by contacting us at support@adaptivebee.com. No charges will be made if automatic subscription renewal is inactive.
G) Illegal activities: Customers may not use our services to commit crimes. In the case of a crime being committed, Adaptivebee retains full rights to suspend the account in question without a refund.
H) Service uptime: Adaptivebee aims to keep server uptime as high as possible. Active paying users get two minutes for every one minute of downtime that exceeds 0.9% downtime per calendar month.
I) Responsibility: Adaptivebee is not to be held responsible for any damages or loss of income caused by using our services.
13. Advertisements.
A) Some part of the ADAPTIVEBEE Software is supported by advertising revenue and may display advertisements and promotions. If UR Browser’s full privacy features are not used these advertisements may be targeted based on browsing habits via cookies and other third party mechanisms while using the ADAPTIVEBEE Software or other information.
B) The manner, mode and extent of advertising by ADAPTIVEBEE on the ADAPTIVEBEE Software is subject to change without specific notice to you.
C) In consideration for ADAPTIVEBEE granting you access to and use of the ADAPTIVEBEE Software, you agree that ADAPTIVEBEE may place such advertising on the ADAPTIVEBEE Software and in any Services provided via ADAPTIVEBEE Software.
14. Controlling Law and Severability.
This License will be governed by and construed in accordance with the laws of France, without regard to or application of conflict of laws rules or principles. The United Nations Convention on Contracts for the International Sale of Goods will not apply. You may not assign or transfer this Agreement or any rights granted hereunder, by operation of law or otherwise, without ADAPTIVEBEE’s prior written consent, and any attempt by you to do so, without such consent, will be void. Except as expressly set forth in this License, the exercise by either party of any of its remedies under this License will be without prejudice to its other remedies under this Agreement or otherwise. Any notices or other communications permitted or required hereunder will be provided to you in one of the following ways: by posting on the ADAPTIVEBEE Site, by email or through notifications in ADAPTIVEBEE Software. The failure by either party to enforce any provision of this License will not constitute a waiver of future enforcement of that or any other provision. Any waiver, modification or amendment of any provision of this Agreement will be effective only if in writing and signed by authorized representatives of both parties. If any provision of this License is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the other provisions will remain in full force and effect.
15. Complete Agreement; Governing Language; Dispute resolution
This License constitutes the entire agreement between you and ADAPTIVEBEE relating to the ADAPTIVEBEE Software (but excluding any services which ADAPTIVEBEE may provide to you under a separate written agreement) and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by ADAPTIVEBEE. Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern, to the extent not prohibited by local law in your jurisdiction. If any part of these Terms are found void and unenforceable, it will not affect the validity of the balance of the Terms, which shall remain valid and enforceable according to its terms. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by these Terms. You may not assign or otherwise transfer by operation of law or otherwise these Terms or any right or obligation herein. The Company expressly reserves its right to assign or transfer these Terms and to delegate any of its obligations hereunder at its sole discretion. The Company's failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
For any dispute you have with us, you agree to first and attempt to resolve the dispute with us informally. The Third Party Content is subject to the third party partners’ terms of services and privacy policies, which may be found on the relevant third party partners’ website. We have no control over such sites, content, advertisement and resources, in which you acknowledge and agree that the Company is not responsible for the availability of such external sites or resources, and does not endorse nor responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Notwithstanding the above, we will make best efforts to monitor and review the Third Party Content to ensure you enhance our service. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Third Party Content, including any goods or services available on or through any such site or resource.
B) Use of the Google Safe Browsing Service is subject to the Google Terms of Service (http://www.google.com/intl/en/policies/terms/regional.html) and to Google's Privacy Policy (http://www.google.com/intl/policies/policies/privacy). By using UR you also agree with these third party terms.
C) Unless otherwise explicitly stated, no affiliation is implied between ADAPTIVEBEE and other third-party service providers.
17. Additional Terms for Specific Features and Extensions for ADAPTIVEBEE Software.
A) The terms in this section apply if you install features or extensions on your copy of ADAPTIVEBEE Software. Extensions are small software programs, developed by ADAPTIVEBEE or third parties, that can modify and enhance the functionality of ADAPTIVEBEE Software. Extensions may have greater privileges to access your browser or your computer than regular webpages, including the ability to read and modify your private data.
B) From time to time, ADAPTIVEBEE Software may check with remote servers hosted by ADAPTIVEBEE for available updates to features and extensions including, but not limited to bug fixes or enhanced functionality. You agree that such updates will be automatically requested, downloaded, and installed without further notice to you.
C) From time to time, ADAPTIVEBEE may discover an extension that violates ADAPTIVEBEE’s terms or other legal agreements, laws, regulations or policies. ADAPTIVEBEE Software may periodically download a list of such extensions from ADAPTIVEBEE’s or other third party servers. You agree that ADAPTIVEBEE may remotely disable or remove any feature or extension from user systems in its sole discretion.

Some of the Third Party Games are available for free, however, other might require payment or subscription. The UR Browser provides access to the Third Party Games, however, ADAPTIVEBEE has no control over the Third Party Games including without limitation their quality or any error, malicious code, delays, inaccuracies, or omissions content contained or displayed therein. E) The background images or wallpapers which come as part of the standard UR Browser package, used by the UR Customization, the UR Homepage features, as well as other features, are used in accordance to the copyright policies and usage permissions listed and approved by the sources, owners or authors of the respective images or wallpapers. These images and wallpapers are solely intended to be used as part of the intended UR Browser functionality for the purpose of personalizing and customizing UR Browser on your personal device. You are not allowed to obtain these images or wallpapers directly from UR Browser or any of its official features or extensions by any means, for any other reason including, but not limited to duplicating, publishing, distributing them or any other commercial use thereof.
F) UR Browser provides you with a built-in file scanner feature that checks your downloaded files for the purpose of keeping your device and browser safe (“ File Scanner”). The File Scanner is developed or licensed to us (as applicable) by third party service providers (i.e., URL reputation scanners, various security APIs, antivirus clouds, etc.), therefore, although we make commercial efforts to ensure that the File Scanner provides you with accurate information and full protection, we do not warrant to the accuracy and sufficiency of the File Scanner and do not take responsibility or liability thereof. Cette politique explique comment ADAPTIVEBEE traite vos informations personnelles et protège votre vie privée lorsque vous utilisez le logiciel ADAPTIVEBEE.

5. Mises à jour logicielles.
Le logiciel ADAPTIVEBEE que vous utilisez peut télécharger et installer automatiquement des mises à jour de temps à autre à partir de ADAPTIVEBEE. Ces mises à jour sont conçues pour améliorer, améliorer et développer le logiciel ADAPTIVEBEE et peuvent prendre la forme de corrections de bogues, de fonctions améliorées, de nouveaux modules logiciels et de versions complètement nouvelles. Vous acceptez de recevoir de telles mises à jour (et autorisez ADAPTIVEBEE à vous les fournir) dans le cadre de votre utilisation du logiciel ADAPTIVEBEE. Ces mises à jour peuvent se produire en une seule fois ou au cours de plusieurs sessions et nécessitent que vous examiniez et acceptiez notre licence alors en vigueur avant d'être autorisé à utiliser toute version ultérieure du logiciel ADAPTIVEBEE. Vous reconnaissez et acceptez que ADAPTIVEBEE n'a aucune obligation de mettre à votre disposition toute version ultérieure du logiciel ADAPTIVEBEE. Vous n'êtes pas obligé d'utiliser les fonctionnalités du logiciel ADAPTIVEBEE, y compris, mais sans s'y limiter, le contenu et les fils de nouvelles.
6. Résiliation.
Cette licence est en vigueur jusqu'à sa résiliation. Vos droits en vertu de cette Licence seront automatiquement résiliés ou cesseront d'être en vigueur sans préavis de ADAPTIVEBEE si vous ne respectez pas les termes de cette Licence. En tout temps, vous pouvez cesser d'utiliser le navigateur UR en désinstallant le navigateur ou en désactivant les Services. Nous nous réservons le droit, à tout moment, de : (i) interrompre, résilier, suspendre ou modifier tout aspect du Service ; ou (ii) résilier les présentes Conditions et votre utilisation du Service avec ou sans motif, et nous ne serons pas responsables envers vous ou un tiers pour ce qui précède. La Société n'assume aucune responsabilité à l'égard de la résiliation du service ou des présentes modalités ou en rapport avec celles-ci. Ces Conditions d'utilisation seront automatiquement résiliées si vous ne vous conformez pas à l'une de ses exigences. En cas de résiliation, vous acceptez de cesser d'utiliser le Service, de quitter et de supprimer le navigateur UR de votre appareil.
Vous le reconnaissez : (i) votre accès et votre utilisation du navigateur UR peuvent être suspendus pendant toute la durée d'une panne imprévue ou imprévue ou de l'indisponibilité d'une partie ou de la totalité des Services pour quelque raison que ce soit, notamment en raison de pannes de courant, de pannes de système ou autres interruptions ; et (ii) nous aurons également le droit, sans engager notre responsabilité envers vous, de suspendre l'accès à tout ou partie du navigateur ou des Services UR à tout moment (a) en cas de panne planifiée pour nous permettre d'effectuer la maintenance ou d'apporter des modifications à tout navigateur ou Service UR ; ou (b) si nous déterminons que l'un des Services est interdit par la loi ou si nous estimons autrement nécessaire ou prudent de le faire pour des raisons légales ou réglementaires (collectivement, " Interruption des Services ").
La disponibilité et la fonctionnalité du navigateur UR dépendent de divers facteurs, notamment des logiciels, du matériel et des réseaux de communication fournis par des tiers. Ces facteurs ne sont pas exempts de faute. La Société ne garantit pas que le navigateur UR fonctionnera sans interruption, erreur ou interruption, ou qu'il sera accessible, ou disponible à tout moment ou qu'il sera à l'abri d'erreurs ou d'accès non autorisé. Nous nous réservons le droit d'ajouter des fonctions supplémentaires au navigateur UR ou de fournir des mises à jour, des mises à niveau ou des corrections de programmation ; nous n'avons aucune obligation de mettre à votre disposition toute version ultérieure du navigateur UR.
En cas de résiliation de la présente Licence, vous cesserez toute utilisation du Logiciel ADAPTIVEBEE et détruirez toutes les copies, totales ou partielles, du Logiciel ADAPTIVEBEE. Les articles 4, 5, 6, 7, 8, 11 et 12 de la présente Licence survivent à une telle résiliation.
7. Services et documents de tiers.
A) Le logiciel ADAPTIVEBEE fait automatiquement référence, affiche et établit des liens vers des sites Web et des informations de tiers situés dans le monde entier sur Internet, et le logiciel ADAPTIVEBEE fournit également ou donne accès à ADAPTIVEBEE et aux services Web de tiers ainsi qu'aux extensions de tiers (collectivement et individuellement, les "Services"). L'utilisation des Services nécessite un accès Internet et l'utilisation de certains Services peut vous obliger à accepter des conditions supplémentaires.
B) En installant et/ou en mettant à jour le logiciel ADAPTIVEBEE, vous reconnaissez et acceptez que le logiciel ADAPTIVEBEE peut être configuré comme votre navigateur par défaut suite à votre consentement explicite et que des raccourcis de recherche sur le bureau et le navigateur UR seront créés afin de fournir un accès facile aux fonctions supportées.
Vous pouvez changer cela à tout moment après l'installation et définir toute autre application comme navigateur par défaut en utilisant les paramètres disponibles dans les navigateurs Internet installés sur votre système ou via les contrôles disponibles dans votre système d'exploitation.
C) Vous acceptez que ADAPTIVEBEE puisse modifier le fournisseur de recherche par défaut du navigateur UR pendant votre utilisation du produit. Si vous ne souhaitez pas que votre fournisseur de recherche par défaut soit modifié, vous pouvez refuser la modification dans le cadre du processus d'installation du logiciel ADAPTIVEBEE ou, après l'installation, vous pouvez désactiver la modification de vos propriétés de recherche en accédant au menu "Outils > Paramètres" du logiciel ADAPTIVEBEE et en sélectionnant l'option "Recherche" souhaitée.
D) En installant UR Browser sur votre ordinateur, vous consentez à l'association des paramètres de recherche à nos partenaires affiliés tiers et à leurs conditions de service: oscobo, lilo, bing, oath;
E) Afin de rendre disponible le service VPN UR d'ADAPTIVEBEE, ADAPTIVEBEE coopère avec des fournisseurs tiers (tels que Stripe pour les opérations de paiement ou les centres de traitement de données, OVPN pour nos services VPN). Si vous souhaitez en savoir plus sur les fournisseurs tiers avec lesquels ADAPTIVEBEE coopère, veuillez lire notre Politique de confidentialité. Ainsi, vous accordez à ADAPTIVEBEE les agréments nécessaires pour y traiter en toute sécurité vos données encodées et/ou votre trafic de données encodées.
F) Nous faisons de notre mieux pour surveiller et choisir nos partenaires et sécuriser les services qui vous sont fournis. NOUS DÉCLINONS TOUTE REPRÉSENTATION ET GARANTIE CONCERNANT LE CONTENU, LES BIENS, LES LOGICIELS OU LES SERVICES QUE VOUS OBTENEZ DE TIERS FOURNISSEURS.
G) Vous comprenez qu'en utilisant le Logiciel ADAPTIVEBEE ou l'un des Services, vous pouvez rencontrer un contenu qui peut être jugé offensant, indécent ou répréhensible, lequel contenu peut ou non être identifié comme ayant un langage explicite, et que les résultats de toute recherche ou entrée d'un URL particulier peuvent générer automatiquement et involontairement des liens ou références au matériel inadéquat. Néanmoins, vous acceptez d'utiliser le logiciel et les services ADAPTIVEBEE à vos risques et périls et que ADAPTIVEBEE n'aura aucune responsabilité envers vous pour tout contenu qui pourrait être jugé offensant, indécent ou choquant.
H) En utilisant le logiciel et les services ADAPTIVEBEE, vous reconnaissez et acceptez que ADAPTIVEBEE n'est pas responsable d'examiner ou d'évaluer le contenu, l'exactitude, l'exhaustivité, l'actualité, la validité, le respect des droits d'auteur, la légalité, la décence, la qualité ou tout autre aspect des documents, extensions ou sites Web des tiers. ADAPTIVEBEE, ses dirigeants, ses sociétés affiliées et ses filiales ne garantissent ni n'endossent et n'assument aucune responsabilité envers vous ou toute autre personne à l'égard des Services de tiers, du matériel de tiers, des extensions ou des sites Web, ou de tout autre matériel, produit ou service de tiers. Le matériel et les extensions de tiers ainsi que les liens vers les sites Web de tiers sont fournis uniquement pour votre commodité.
I) Les informations financières affichées par le logiciel ADAPTIVEBEE ou tout autre service ne sont fournies qu'à titre d'information générale et ne doivent pas être considérées comme des conseils de placement. Avant d'exécuter toute transaction sur titres sur la base des informations obtenues par le biais du logiciel ou des services ADAPTIVEBEE, vous devriez consulter un professionnel financier ou en valeurs mobilières légalement qualifié pour donner des conseils financiers ou en valeurs mobilières dans votre pays ou région. Les données de localisation fournies par le logiciel ADAPTIVEBEE ou tout autre service ne sont fournies qu'à des fins de navigation de base et ne sont pas destinées à être utilisées dans des situations où des informations de localisation précises sont nécessaires ou lorsque des données de localisation erronées, inexactes, différées ou incomplètes peuvent entraîner des dommages corporels, matériels ou environnementaux. Ni ADAPTIVEBEE ni aucun de ses fournisseurs de contenu ne garantit la disponibilité, l'exactitude, l'exhaustivité, la fiabilité ou l'actualité des informations sur les stocks, les données de localisation ou toute autre donnée affichée par le logiciel ADAPTIVEBEE ou tout autre service.
J) Vous convenez que les Services contiennent du contenu, des renseignements et du matériel exclusifs appartenant à ADAPTIVEBEE et/ou à ses concédants de licence, et qu'ils sont protégés par les lois applicables en matière de propriété intellectuelle et autres lois, y compris, mais sans s'y limiter, le droit d'auteur, et que vous ne pourrez utiliser ce contenu, renseignements ou matériel exclusif d'aucune façon, sauf pour utiliser les Services ou en violation des modalités de cette Licence ou des droits de propriété intellectuelle de tiers ou de ADAPTIVEBEE de quelque manière que ce soit. Aucune partie des Services ne peut être reproduite sous quelque forme ou par quelque moyen que ce soit. Vous acceptez de ne pas modifier, louer, louer, prêter, vendre, distribuer ou créer d'œuvres dérivées basées sur les Services, de quelque manière que ce soit, et vous ne devez pas exploiter les Services d'une manière non autorisée, y compris, mais sans s'y limiter, utiliser les Services pour transmettre des virus informatiques, vers, chevaux de Troie ou autres malwares, ou par intrusion ou surcharge de capacité réseau. Vous acceptez en outre de ne pas utiliser les Services de quelque manière que ce soit pour harceler, abuser, traquer, menacer, diffamer ou autrement enfreindre ou violer les droits de toute autre partie, et que ADAPTIVEBEE n'est en aucun cas responsable d'une telle utilisation par vous, ni de tout harcèlement, menace, diffamation, offensive, infraction ou messages ou transmissions illégales que vous pourriez recevoir en raison de l'utilisation des Services.
K) ADAPTIVEBEE et ses concédants de licence se réservent le droit de modifier, suspendre, supprimer ou désactiver l'accès aux Services à tout moment et sans préavis. En aucun cas, ADAPTIVEBEE ne sera responsable de la suppression ou de la désactivation de l'accès à ces Services. ADAPTIVEBEE peut également imposer des limites sur l'utilisation ou l'accès à certains Services, dans tous les cas et sans préavis ni responsabilité.
8. Exonération de garantie.
A) Si vous êtes un client qui est un consommateur (quelqu'un qui utilise le logiciel ADAPTIVEBEE en dehors de votre commerce, de votre entreprise ou de votre profession), vous pouvez avoir des droits légaux dans votre pays de résidence qui interdiraient les limitations suivantes de s'appliquer à vous, et si elles ne s'appliquent pas à vous. Pour en savoir plus sur les droits, vous devriez communiquer avec un organisme local de conseils aux consommateurs.
B) VOUS RECONNAISSEZ ET ACCEPTEZ EXPRESSÉMENT QUE L'UTILISATION DU LOGICIEL ADAPTIVEBEE SE FAIT AUX RISQUES ET PÉRILS DE YOUR ET QUE VOUS ASSUMEZ TOUS LES RISQUES QUANT À LA QUALITÉ SATISFAISANTE, LA PERFORMANCE, L'EXACTITUDE ET L'EFFORT.
C) DANS TOUTE LA MESURE PERMISE PAR LA LOI APPLICABLE, LE LOGICIEL ADAPTIVEBEE ET TOUS LES SERVICES ADAPTIVEBEE OU FOURNIS PAR DES TIERS PAR LE LOGICIEL ADAPTIVEBEE (COLLECTIVEMENT " SERVICES ") SONT FOURNIS " TELS QUELS " ET " TELS QUE DISPONIBLES ", AVEC TOUS LES DÉFAUTS ET SANS AUCUNE GARANTIE, ET ADAPTIVEBEE ET ADAPTIVEBEE'S LICENSORS'S LICENSORS (RENVOYÉS COLLECTIVEMENT AU "ADAPTIVEBEE" POUR LES PURPOSES DES SECTIONS 7 et 8) DÉCLARENT PAR LA PRÉSENTE toutes les garanties et conditions relatives au logiciel et aux services ADAPTIVEBEE, EXPRESSEMENT, IMPLICITE OU LÉGALE, Y COMPRIS, MAIS SANS S'Y LIMITER, LES GARANTIES ET/OU CONDITIONS IMPLICITES DE QUALITÉ MARCHANDE, DE QUALITÉ SATISFAISANTE, D'APTITUDE À UN USAGE PARTICULIER, D'EXACTITUDE, DE JOUISSANCE PAISIBLE ET DE NON-VIOLATION DES DROITS DES TIERS.
D) ADAPTIVEBEE NE GARANTIT PAS CONTRE TOUTE INTERFÉRENCE AVEC LA JOUISSANCE DU LOGICIEL ET DES SERVICES ADAPTIVEBEE PAR YOUR, QUE LES FONCTIONS CONTENUES DANS, OU LES SERVICES EXÉCUTÉS OU FOURNIS PAR, LE LOGICIEL ADAPTIVEBEE RÉPONDRONT AUX EXIGENCES YOUR, QUE LE FONCTIONNEMENT DU LOGICIEL OU DES SERVICES ADAPTIVEBEE SERA CONTINU OU SANS ERREUR, QUE TOUT SERVICE SERA RENDU DISPONIBLE, QUE LE LOGICIEL ADAPTIVEBEE OU LES SERVICES SERONT COMPATIBLES AVEC UN AUTRE LOGICIEL OU SERVICE TIERS OU QUE LES DÉFAUTS DU LOGICIEL OU SERVICES ADAPTIVEBEE SERONT CORRIGÉS.
E) VOUS RECONNAISSEZ QUE LE LOGICIEL ET LES SERVICES ADAPTIVEBEE NE SONT PAS DESTINÉS OU ADAPTÉS À ÊTRE UTILISÉS DANS DES SITUATIONS OU DES ENVIRONNEMENTS OÙ LE LOGICIEL OU LES SERVICES ADAPTIVEBEE NE SONT PAS DESTINÉS OU ADAPTÉS À ÊTRE UTILISÉS DANS DES SITUATIONS OU DES ENVIRONNEMENTS DANS LESQUELS LE CONTENU, LES DONNÉES OU LES INFORMATIONS FOURNIES PAR ADAPTIVEBEE, DES ERREURS OU DES INEXACTITUDES DANS LE LOGICIEL OU LES SERVICES PEUVENT ENTRAÎNER LA MORT, DES DOMMAGES CORPORELS OU ENVIRONNEMENTAUX GRAVES, NOTAMMENT L'EXPLOITATION DES INSTALLATIONS NUCLÉAIRES, DE LA NAVIGATION AÉRONAUTIQUE, DES COMMUNICATIONS, DE LA CIRCULATION AÉRIENNE OU DE SYSTÈMES D'ARME, OU DU MAINTIEN EN VIE.
F) AUCUNE INFORMATION OU CONSEIL ORAL OU ÉCRIT DONNÉ PAR ADAPTIVEBEE OU UN REPRÉSENTANT AUTORISÉ DE ADAPTIVEBEE NE PEUT CRÉER UNE GARANTIE. SI LE LOGICIEL OU LES SERVICES ADAPTIVEBEE S'AVÈRENT DÉFECTUEUX, VOUS ASSUMEZ L'INTÉGRALITÉ DES FRAIS D'ENTRETIEN, DE RÉPARATION OU DE CORRECTION NÉCESSAIRES. CERTAINES JURIDICTIONS N'AUTORISENT PAS L'EXCLUSION DES GARANTIES IMPLICITES OU DES LIMITATIONS DES DROITS STATUTAIRES APPLICABLES D'UN CONSOMMATEUR, DE SORTE QUE L'EXCLUSION ET LES LIMITATIONS CI-DESSUS PEUVENT NE PAS S'APPLIQUER À VOUS.
9. Limitation de responsabilité..
DANS LA MESURE OÙ LA LOI APPLICABLE NE L'INTERDIT PAS, ADAPTIVEBEE NE PEUT EN AUCUN CAS ÊTRE TENU RESPONSABLE DES INJONCTIONS PERSONNELLES, OU DE TOUT DOMMAGE ACCESSOIRE, SPÉCIAL, INDIRECT OU CONSÉCUTIF QUEL QU'IL SOIT, Y COMPRIS, SANS LIMITATION, LES DOMMAGES POUR PERTE DE PROFITS, CORRUPTION OU PERTE DE DONNÉES, DÉFAUT DE TRANSMETTRE OU DE RECEVOIR DES DONNÉES, INTERRUPTION D'ACTIVITÉ OU TOUT AUTRE DOMMAGE OU PERTE COMMERCIALE, DÉCOULANT DE L'UTILISATION OU DE L'IMPOSSIBILITÉ D'UTILISER LE LOGICIEL ET LES SERVICES ADAPTIVEBEE OU TOUT LOGICIEL OU APPLICATION D'UN TIERS EN CONJONCTION AVEC LE LOGICIEL ADAPTIVEBEE, QUELLE QU'EN SOIT LA CAUSE, INDÉPENDAMMENT DE LA THÉORIE DE LA RESPONSABILITÉ (CONTRACTUELLE, DÉLICTUELLE OU AUTRE) ET MÊME SI ADAPTIVEBEE A ÉTÉ INFORMÉ DE LA POSSIBILITÉ DE TELS DOMMAGES. CERTAINES JURIDICTIONS N'AUTORISENT PAS LA LIMITATION DE LA RESPONSABILITÉ EN CAS D'INJONCTION PERSONNELLE OU DE DOMMAGES ACCESSOIRES OU CONSÉCUTIFS, DE SORTE QUE CETTE LIMITATION PEUT NE PAS S'APPLIQUER À VOUS. En aucun cas, la responsabilité totale de l'ADAPTIVEBEE envers vous pour tous les dommages-intérêts (sauf si la loi applicable l'exige dans les cas de blessures corporelles) ne dépassera le montant de cinquante dollars (50,00 $). Les limitations qui précèdent s'appliqueront même si le remède susmentionné n'atteint pas son objectif essentiel.
10. Contrôle des exportations.
Vous acceptez de vous conformer pleinement à toutes les lois et réglementations d'exportation de l'ABC04 pour vous assurer que ni le logiciel ADAPTIVEBEE, ni aucune donnée technique y afférente, ni aucun produit direct ne sont exportés ou réexportés directement ou indirectement en violation de ces lois et réglementations, ou utilisés à toute fin interdite par celles-ci.
11. Droits d'auteur et politique de propriété intellectuelle
ADAPTIVEBEE respecte le droit d'auteur et attend de ses utilisateurs qu'ils fassent de même. ADAPTIVEBEE a mis en place des politiques et des ressources dédiées pour agir efficacement en matière de droit d'auteur. Si vous pensez qu'une œuvre résidant dans UR Browser viole un droit d'auteur, veuillez nous envoyer un avis de violation de droit d'auteur à notre adresse électronique (contact@adaptivebee.com) et nous nous en occuperons dès que possible.
Vous devez inclure les renseignements suivants dans votre avis : (a) une signature physique ou électronique du titulaire du droit d'auteur ou d'une personne autorisée à agir en son nom ; (b) l'identification de l'œuvre protégée par le droit d'auteur présumée avoir été violée ; (c) une description de la nature et de l'emplacement exact du contenu que vous prétendez violer votre copyright, suffisamment détaillée pour que ADAPTIVEBEE puisse repérer et identifier ce contenu ; (d) votre nom, votre adresse et votre adresse électronique ; (e) une déclaration selon laquelle vous croyez de bonne foi que l'utilisation du matériel de la manière décrite dans votre avis n'est pas autorisée par le titulaire du droit d'auteur, son agent ou la loi ; et (f) une déclaration selon laquelle l'information contenue dans cet avis est exacte et que vous êtes le titulaire du droit d'auteur ou une personne autorisée à agir pour leur compte.
12. Paiement.
A) ADAPTIVEBEE ne stocke pas de données dans le VPN du navigateur UR qui pourraient permettre une interférence avec vos données personnelles. Pour toutes les opérations qui impliquent le stockage de données personnelles, comme par exemple les opérations de paiement, ADAPTIVEBEE coopère avec des fournisseurs tiers, qui se chargent du stockage séparé des données, de plus ADAPTIVEBEE agit comme un'proxy' entre des tiers et fait des efforts pour déconnecter les données, comme le paiement vs fournisseurs VPN. B) Les paiements sont toujours effectués à l'avance pour les services de l'ADAPTIVEBEE. ADAPTIVEBEE permet actuellement le paiement par carte de crédit et permettra à l'avenir d'autres méthodes de paiement différentes, y compris PayPal, Bitcoin et autres. La période d'abonnement commence lorsque ADAPTIVEBEE reçoit le paiement. Si vous vous trouvez dans l'Union Européenne, tous les prix indiqués incluent la TVA du pays d'où vous vous rendez. En dehors de l'UE, la TVA n'est pas facturée.
C) Périodes de souscription : ADAPTIVEBEE offre trois longueurs d'abonnement différentes. 1 mois (31 jours), 3 mois (93 jours) et 1 an (366 jours). Le contrat entre ADAPTIVEBEE SASU et le client est valable aussi longtemps que la durée de l'abonnement.
D) Abonnement personnel : Les abonnements sont personnels et ne peuvent être transférés ou utilisés par d'autres personnes. Si plusieurs utilisateurs utilisent le même compte, il sera immédiatement suspendu sans aucune option de remboursement, car il est considéré comme une violation directe de cet accord.
E) Politique de remboursement : ADAPTIVEBEE offre une garantie de remboursement de 10 jours pour les premiers achats. Conformément à la loi française en vertu de laquelle ADAPTIVEBEE opère, nous nous réservons le droit de refuser le remboursement des achats de renouvellement. Le client doit contacter ADAPTIVEBEE dans les 10 jours suivant le premier paiement par e-mail ou par chat pour que la garantie de remboursement soit valable. S'il vous plaît considérer, même si exceptionnellement ainsi, les remboursements peuvent prendre jusqu'à 30 jours dans le traitement jusqu'à ce que votre compte soit remboursé.
F) Renouvellement des abonnements : Les abonnements se renouvellent automatiquement lorsque le paiement est effectué. Toutes nos offres incluent un renouvellement automatique de l'abonnement. Le client peut, à tout moment, désactiver le renouvellement automatique en nous contactant à support@adaptivebee.com Aucun frais ne sera facturé si le renouvellement automatique de l'abonnement est inactif.
G) Activités illégales : Les clients ne peuvent pas utiliser nos services pour commettre des crimes. En cas d'infraction, ADAPTIVEBEE se réserve le droit de suspendre le compte en question sans remboursement.
H) Disponibilité du service : ADAPTIVEBEE vise à maintenir la disponibilité du serveur aussi élevée que possible. Les utilisateurs payants actifs obtiennent deux minutes pour chaque minute d'indisponibilité qui dépasse 0,9 % par mois civil.
I) Responsabilité : ADAPTIVEBEE n'est pas responsable des dommages ou pertes de revenus causés par l'utilisation de nos services.
13. Annonces publicitaires.
A) Une partie du logiciel ADAPTIVEBEE est supportée par les revenus publicitaires et peut afficher des publicités et des promotions. D) Sie sind nicht berechtigt und stimmen zu, den Quellcode der ADAPTIVEBEE-Software oder eines Teils davon abzuleiten, zu entschlüsseln, zu modifizieren, abgeleitete Werke zu erstellen oder anderen zu ermöglichen, es sei denn, eine der vorgenannten Einschränkungen ist durch geltendes Recht verboten oder in dem Maße, wie es durch Lizenzbedingungen für die Verwendung von Open-Source-Komponenten, die in der ADAPTIVEBEE-Software enthalten sind, zulässig ist). Jeder Versuch, dies zu tun, stellt eine Verletzung der Rechte von ADAPTIVEBEE und seinen Lizenzgebern der ADAPTIVEBEE-Software dar. ADAPTIVEBEE besitzt kein FFmpeg (https://ffmpeg.org).
3. Übertragung.
Sie dürfen die ADAPTIVEBEE-Software nicht vermieten, verleasen, verleihen, verkaufen, weitergeben oder unterlizenzieren. Sie können jedoch eine einmalige dauerhafte Übertragung aller Ihrer Lizenzrechte an der ADAPTIVEBEE-Software auf eine andere Partei vornehmen, vorausgesetzt, dass: (a) Die Übertragung muss die gesamte ADAPTIVEBEE-Software umfassen, einschließlich aller ihrer Bestandteile, Originalmedien (falls vorhanden), Druckmaterialien und dieser Lizenz; (b) Sie behalten keine Kopien der ADAPTIVEBEE-Software, ganz oder teilweise, einschließlich Kopien, die auf einem Computer oder einem anderen Speichermedium gespeichert sind; und (c) die Partei, die die ADAPTIVEBEE-Software erhält, liest und stimmt zu, die Bedingungen dieser Lizenz zu akzeptieren. 4. Einwilligung in die Verwendung der Daten.

Sie erklären sich damit einverstanden, dass ADAPTIVEBEE diagnostische, technische und damit zusammenhängende anonyme Informationen, einschließlich, aber nicht beschränkt auf, Informationen über Ihren Computer, Ihre System- und Anwendungssoftware und Peripheriegeräte, die regelmäßig erfasst werden, sammeln, um die Bereitstellung von Software-Updates, Produktsupport und anderen Dienstleistungen für Sie (falls vorhanden) im Zusammenhang mit der ADAPTIVEBEE-Software zu erleichtern und die Einhaltung der Bedingungen dieser Lizenz zu überprüfen. ADAPTIVEBEE kann diese Informationen, solange sie anonym in einer Form gesammelt werden, die Sie nicht persönlich identifiziert, verwenden, um die Produkte und Dienstleistungen von ADAPTIVEBEE anzubieten und zu verbessern.
B) Lesezeichen und lokale Daten. Durch die Installation des UR Browsers können Sie zustimmen, dass Sie zum Zeitpunkt der Nutzung der spezifischen Funktionen dieses Browsers Lesezeichen, Verlauf, gespeicherte Passwörter und Cookies aus anderen Browsern lokal importieren dürfen.

Diese Richtlinie erläutert, wie ADAPTIVEBEE mit Ihren persönlichen Daten umgeht und Ihre Privatsphäre schützt, wenn Sie die ADAPTIVEBEE-Software verwenden.
D) Sie stimmen der Verwendung Ihrer Daten in Übereinstimmung mit der Datenschutzerklärung von ADAPTIVEBEE Software zu.
5. Software-updates.
Die von Ihnen verwendete ADAPTIVEBEE-Software kann von Zeit zu Zeit automatisch Updates von ADAPTIVEBEE herunterladen und installieren. Diese Updates dienen der Verbesserung, Verbesserung und Weiterentwicklung der ADAPTIVEBEE-Software und können in Form von Bugfixes, erweiterten Funktionen, neuen Softwaremodulen und völlig neuen Versionen erfolgen. Sie erklären sich damit einverstanden, solche Updates als Teil Ihrer Nutzung der ADAPTIVEBEE-Software zu erhalten (und erlauben ADAPTIVEBEE, diese an Sie zu liefern). Diese Aktualisierungen können auf einmal oder über mehrere Sitzungen erfolgen und erfordern Ihre Überprüfung und Annahme unserer damals aktuellen Lizenz, bevor Sie alle nachfolgenden Versionen der ADAPTIVEBEE-Software verwenden dürfen. Sie erkennen an und stimmen zu, dass ADAPTIVEBEE nicht verpflichtet ist, Ihnen alle nachfolgenden Versionen der ADAPTIVEBEE-Software zur Verfügung zu stellen. Sie sind nicht verpflichtet, die Funktionen der ADAPTIVEBEE-Software zu nutzen, einschließlich, aber nicht beschränkt auf Inhalte und Newsfeeds.
6. Kündigung.
Diese Lizenz gilt bis zur Kündigung. Ihre Rechte unter dieser Lizenz erlöschen automatisch oder anderweitig ohne Vorankündigung von ADAPTIVEBEE, wenn Sie sich nicht an die Bestimmungen dieser Lizenz halten. Sie können die Verwendung des Browsers UR jederzeit einstellen, indem Sie den Browser deinstallieren oder die Dienste deaktivieren. Wir behalten uns das Recht vor, jederzeit: (i) den Service einzustellen, zu beenden, auszusetzen oder zu modifizieren; oder (ii) diese Bedingungen und Ihre Nutzung des Service mit oder ohne Grund zu beenden, und wir haften weder Ihnen noch einem Dritten gegenüber für einen der vorgenannten Punkte. Das Unternehmen übernimmt keine Verantwortung in Bezug auf oder im Zusammenhang mit der Beendigung des Dienstes oder dieser Bedingungen. Diese Bedingungen werden automatisch beendet, wenn Sie eine der Anforderungen nicht erfüllen. Bei einer Kündigung stimmen Sie zu, die Nutzung des Dienstes einzustellen, den Browser UR zu beenden und von Ihrem Gerät zu entfernen.
Das erkennen Sie an: (i) Ihr Zugriff auf den Browser UR und Ihre Nutzung des Browsers UR kann für die Dauer unvorhergesehener oder ungeplanter Ausfallzeiten oder der Nichtverfügbarkeit eines Teils oder aller Dienste aus irgendeinem Grund ausgesetzt werden, einschließlich als Folge von Stromausfällen, Systemausfällen oder anderen Unterbrechungen; und (ii) sind wir auch berechtigt, ohne jegliche Haftung Ihnen gegenüber den Zugang zu einem Teil oder allen UR-Browsern oder -Diensten jederzeit auszusetzen, (a) um planmäßige Ausfallzeiten zu vermeiden, die es uns ermöglichen, Wartungsarbeiten durchzuführen oder Änderungen an einem der UR-Browser oder -Dienste vorzunehmen; oder (b) für den Fall, dass wir feststellen, dass einer der Dienste gesetzlich verboten ist oder wir anderweitig feststellen, dass es aus rechtlichen oder regulatorischen Gründen notwendig oder umsichtig ist (zusammen "Serviceunterbrechungen").
Die Verfügbarkeit und Funktionalität des Browsers UR hängt von verschiedenen Faktoren ab, darunter Software, Hardware und Kommunikationsnetze, die von Dritten bereitgestellt werden. Diese Faktoren sind nicht fehlerfrei. Das Unternehmen garantiert nicht, dass die UR-Browsing ohne Unterbrechung, Fehler oder Unterbrechungen funktioniert, dass sie jederzeit zugänglich oder verfügbar ist oder gegen Fehler oder unbefugten Zugriff immun ist. 7. Dienstleistungen und Materialien von Drittanbietern.
A) Die ADAPTIVEBEE-Software verweist automatisch auf Websites und Informationen von Drittanbietern, die sich weltweit im Internet befinden, und die ADAPTIVEBEE-Software führt auch Webservices von ADAPTIVEBEE und Drittanbietern sowie Erweiterungen von Drittanbietern (zusammen und einzeln "Dienste") durch oder gewährt Zugang dazu. Die Nutzung der Dienste erfordert einen Internetzugang und die Nutzung bestimmter Dienste kann die Annahme zusätzlicher Bedingungen erfordern.
B) Durch die Installation und/oder Aktualisierung der ADAPTIVEBEE-Software erkennen Sie an und stimmen zu, dass die ADAPTIVEBEE-Software als Ergebnis Ihrer ausdrücklichen Zustimmung als Standardbrowser eingestellt werden kann und dass Desktop-Verknüpfungen für die Suche und den UR-Browser erstellt werden, um einen einfachen Zugriff auf die unterstützten Funktionen zu ermöglichen.
Sie können dies nach der Installation jederzeit ändern und jede andere Anwendung als Standardbrowser einstellen, indem Sie die Einstellungen der auf Ihrem System installierten Internetbrowser oder der in Ihrem Betriebssystem verfügbaren Bedienelemente verwenden.
C) Sie stimmen zu, dass ADAPTIVEBEE den Standardsuchanbieter des UR-Browsers während der Nutzung des Produkts ändern kann. Wenn Sie Ihren Standardsuchanbieter nicht ändern lassen möchten, können Sie die Änderung im Rahmen der Installation der ADAPTIVEBEE-Software ablehnen oder nach der Installation die Änderung Ihrer Sucheigenschaften deaktivieren, indem Sie das Menü "Extras > Einstellungen" der ADAPTIVEBEE-Software aufrufen und die gewünschte Option "Suchen" auswählen.
D) Durch die Installation von UR Browser auf Ihrem Computer stimmen Sie der Zuordnung der Sucheinstellungen zu unseren Affiliate-Partnern und deren Nutzungsbedingungen zu: oscobo, lilo, bing, oath;
E) Um den UR-VPN-Dienst von ADAPTIVEBEE zur Verfügung zu stellen, arbeitet ADAPTIVEBEE mit Drittanbietern zusammen (z.B. Stripe for payment operations oder Rechenzentren, OVPN for our VPN-Services). Wenn Sie mehr über die Drittanbieter erfahren möchten, mit denen ADAPTIVEBEE zusammenarbeitet, lesen Sie bitte unsere Datenschutzerklärung. Damit erteilen Sie ADAPTIVEBEE die notwendigen Genehmigungen, um Ihre verschlüsselten Daten und/oder Ihren verschlüsselten Datenverkehr dort sicher zu verarbeiten.
F) Wir sind bestrebt, unsere Partner zu überwachen und auszuwählen und die für Sie erbrachten Dienstleistungen zu sichern. WIR LEHNEN ALLE ZUSICHERUNGEN UND GARANTIEN IN BEZUG AUF INHALTE, WAREN, SOFTWARE ODER DIENSTLEISTUNGEN AB, DIE SIE VON DRITTEN ANBIETERN ERHALTEN.
G) Sie verstehen, dass Sie durch die Nutzung der ADAPTIVEBEE-Software oder eines der Dienste auf Inhalte stoßen können, die als anstößig, unanständig oder anstößig erachtet werden können, wobei diese Inhalte als explizit sprachlich gekennzeichnet sein können oder auch nicht, und dass die Ergebnisse einer Suche oder Eingabe eines bestimmten URL automatisch und unbeabsichtigt Links oder Verweise auf anstößiges Material erzeugen können. H) Durch die Nutzung der ADAPTIVEBEE-Software und -Dienstleistungen erkennen Sie an und stimmen zu, dass ADAPTIVEBEE nicht verantwortlich ist für die Prüfung oder Bewertung des Inhalts, der Genauigkeit, Vollständigkeit, Aktualität, Gültigkeit, Urheberrechtskonformität, Rechtmäßigkeit, Anständigkeit, Qualität oder eines anderen Aspekts von Materialien, Erweiterungen oder Websites Dritter. ADAPTIVEBEE, seine Führungskräfte, verbundenen Unternehmen und Tochtergesellschaften garantieren oder unterstützen nicht und übernehmen keine Haftung oder Verantwortung Ihnen oder einer anderen Person gegenüber für Dienstleistungen von Dritten, Materialien von Dritten, Erweiterungen oder Websites oder für andere Materialien, Produkte oder Dienstleistungen von Dritten. Materialien und Erweiterungen von Drittanbietern sowie Links zu Websites von Drittanbietern werden ausschließlich aus Gründen der Benutzerfreundlichkeit bereitgestellt.
I) Finanzinformationen, die von der ADAPTIVEBEE Software oder den Dienstleistungen angezeigt werden, dienen nur zu allgemeinen Informationszwecken und sollten nicht als Anlageberatung verwendet werden. J) Sie erklären sich damit einverstanden, dass die Dienste urheberrechtlich geschützte Inhalte, Informationen und Materialien enthalten, die ADAPTIVEBEE und/oder seinen Lizenzgebern gehören und durch geltende Gesetze zum Schutz geistigen Eigentums und andere Gesetze, einschließlich, aber nicht beschränkt auf das Urheberrecht, geschützt sind, und dass Sie diese urheberrechtlich geschützten Inhalte, Informationen oder Materialien in keiner Weise verwenden werden, mit Ausnahme der zulässigen Nutzung der Dienste oder in einer Weise, die mit den Bedingungen dieser Lizenz unvereinbar ist oder die geistige Eigentumsrechte Dritter oder ADAPTIVEBEE verletzt. Kein Teil der Dienste darf in irgendeiner Form oder mit irgendwelchen Mitteln reproduziert werden. Sie erklären sich damit einverstanden, die Dienste in keiner Weise zu ändern, zu vermieten, zu verleasen, zu verleihen, zu verkaufen, zu vertreiben oder abgeleitete Werke auf der Grundlage der Dienste zu erstellen, und Sie dürfen die Dienste in keiner Weise unbefugten Weise nutzen, einschließlich, aber nicht beschränkt auf die Nutzung der Dienste zur Übertragung von Computerviren, Würmern, trojanischen Pferden oder anderer Malware oder durch unbefugtes Betreten oder Belasten der Netzwerkkapazität. Sie stimmen ferner zu, die Dienste in keiner Weise zu nutzen, um die Rechte einer anderen Partei zu belästigen, zu missbrauchen, zu verfolgen, zu bedrohen, zu verleumden oder anderweitig zu verletzen oder zu verletzen, und dass ADAPTIVEBEE in keiner Weise für eine solche Nutzung durch Sie verantwortlich ist, noch für eine belästigende, bedrohende, diffamierende, beleidigende, beleidigende, verletzende oder illegale Nachrichten oder Übertragungen, die Sie als Folge der Nutzung eines der Dienste erhalten können.
K) ADAPTIVEBEE und seine Lizenzgeber behalten sich das Recht vor, den Zugriff auf Dienste jederzeit und ohne Vorankündigung zu ändern, auszusetzen, zu entfernen oder zu deaktivieren. In keinem Fall ist ADAPTIVEBEE für die Entfernung oder Deaktivierung des Zugangs zu diesen Diensten verantwortlich. ADAPTIVEBEE kann auch Beschränkungen für die Nutzung oder den Zugriff auf bestimmte Dienste vorschreiben, in jedem Fall und ohne Vorankündigung oder Haftung.
8. Haftungsausschluss für Garantien
A) Wenn Sie ein Kunde sind, der ein Verbraucher ist (jemand, der die ADAPTIVEBEE-Software außerhalb Ihres Handels, Geschäfts oder Berufs verwendet), haben Sie möglicherweise gesetzliche Rechte in Ihrem Wohnsitzland, die es verbieten würden, dass die folgenden Einschränkungen auf Sie zutreffen, und wenn sie verboten sind, gelten sie nicht für Sie. C) SOWEIT NACH GELTENDEM RECHT ZULÄSSIG, WERDEN DIE ADAPTIVEBEE-SOFTWARE UND ALLE VON DER ADAPTIVEBEE-SOFTWARE ERBRACHTEN ODER ERBRACHTEN DIENSTLEISTUNGEN VON ADAPTIVEBEE ODER DRITTEN (ZUSAMMEN "DIENSTLEISTUNGEN") "WIE BESEHEN" UND "WIE VERFÜGBAR", MIT ALLEN FEHLERN UND OHNE JEGLICHE GEWÄHRLEISTUNG BEREITGESTELLT, UND ADAPTIVEBEE UND ADAPTIVEBEE LIZENZGEBER (KOLLEKTIV ALS "ADAPTIVEBEE" FÜR DIE PURPOSE DER ABSCHNITT 7 und 8 BEREICHE) HIER DÜRFEN ALLE GEWÄHRLEISTUNGEN UND BEDINGUNGEN IN BEZUG AUF DIE ADAPTIVEBEE-SOFTWARE UND DIENSTLEISTUNGEN, MIT AUSDRUCK, IMPLIZIT ODER GESETZLICH VORGESCHRIEBEN, EINSCHLIEßLICH, ABER NICHT BESCHRÄNKT AUF, DIE IMPLIZITEN GARANTIEN UND/ODER BEDINGUNGEN DER MARKTGÄNGIGKEIT, DER ZUFRIEDENSTELLENDEN QUALITÄT, DER EIGNUNG FÜR EIN BESTIMMTES PURPOSE, DER AKKURACY, DES STILLEN GENUSSES UND DER NICHTVERLETZUNG VON RECHTEN DRITTER.
D) ADAPTIVEBEE GARANTIERT NICHT GEGEN BEEINTRÄCHTIGUNG DER NUTZUNG DER ADAPTIVEBEE-SOFTWARE UND -DIENSTE DURCH YOUR, DASS DIE IN DER ADAPTIVEBEE-SOFTWARE ENTHALTENEN FUNKTIONEN ODER DIENSTE, DIE VON DER ADAPTIVEBEE-SOFTWARE AUSGEFÜHRT ODER BEREITGESTELLT WERDEN, DEN ANFORDERUNGEN VON YOUR ENTSPRECHEN, DASS DER BETRIEB DER ADAPTIVEBEE-SOFTWARE ODER -DIENSTE UNUNTERBROCHEN ODER FEHLERFREI IST, DASS WEITERHIN EIN DIENST ZUR VERFÜGUNG GESTELLT WIRD, DASS DIE ADAPTIVEBEE-SOFTWARE ODER -DIENSTE MIT SOFTWARE ODER ANDEREN DIENSTEN VON DRITTANBIETERN KOMPATIBEL SIND ODER DASS MÄNGEL IN DER ADAPTIVEBEE-SOFTWARE ODER -DIENSTEN BEHOBEN WERDEN.
E) SIE FURTHER ERKENNEN AN, DASS DIE ADAPTIVEBEE-SOFTWARE UND -DIENSTE NICHT FÜR DIE VERWENDUNG IN SITUATIONEN ODER UMGEBUNGEN BESTIMMT ODER GEEIGNET SIND, IN DENEN DER AUSFALL ODER DIE ZEITLICHE VERZÖGERUNG ODER FEHLER ODER UNGENAUIGKEITEN IN DEN INHALTEN, DATEN ODER INFORMATIONEN, DIE VON DER ADAPTIVEBEE-SOFTWARE ODER DEN DIENSTEN BEREITGESTELLT WERDEN, ZU TOD, PERSÖNLICHER VERLETZUNG ODER SCHWEREN KÖRPERLICHEN ODER ÖKOLOGISCHEN SCHÄDEN FÜHREN KÖNNTEN, EINSCHLIEßLICH, ABER NICHT BESCHRÄNKT AUF DEN BETRIEB VON KERNANLAGEN, FLUGZEUGNAVIGATIONS- ODER KOMMUNIKATIONSSYSTEMEN, FLUGSICHERUNGS-, LEBENSERHALTUNGS- ODER WAFFENSYSTEMEN.
F) KEINE MÜNDLICHEN ODER SCHRIFTLICHEN INFORMATIONEN ODER RATSCHLÄGE VON ADAPTIVEBEE ODER EINEM AUTORISIERTEN VERTRETER VON ADAPTIVEBEE BEGRÜNDEN EINE GARANTIE. SOLLTE SICH DIE ADAPTIVEBEE-SOFTWARE ODER -DIENSTLEISTUNGEN ALS FEHLERHAFT ERWEISEN, ÜBERNEHMEN SIE DIE GESAMTEN KOSTEN FÜR ALLE NOTWENDIGEN WARTUNGS-, REPARATUR- ODER KORREKTURARBEITEN. EINIGE RECHTSPRECHUNGEN ERLAUBEN DEN AUSSCHLUSS STILLSCHWEIGENDER GARANTIEN ODER EINSCHRÄNKUNGEN DER ANWENDBAREN GESETZLICHEN RECHTE EINES VERBRAUCHERS NICHT, SO DASS DIE OBEN GENANNTEN AUSSCHLÜSSE UND EINSCHRÄNKUNGEN MÖGLICHERWEISE NICHT FÜR SIE GELTEN.
9. Haftungsbeschränkung.
SOWEIT NICHT DURCH GELTENDES RECHT VERBOTEN, IST ADAPTIVEBEE IN KEINEM FALL HAFTBAR FÜR PERSONENBEZOGENE SCHÄDEN ODER ZUFÄLLIGE, SPEZIELLE, INDIREKTE ODER FOLGESCHÄDEN JEGLICHER ART, EINSCHLIEßLICH, ABER NICHT BESCHRÄNKT AUF SCHÄDEN FÜR GEWINNAUSFALL, KORRUPTION ODER DATENVERLUST, FAILURE ZUR ÜBERTRAGUNG ODER ZUM EMPFANG VON DATEN, GESCHÄFTSUNTERBRECHUNGEN ODER ANDEREN KOMMERZIELLEN SCHÄDEN ODER VERLUSTEN, DIE SICH AUS DER ODER IM ZUSAMMENHANG MIT DER NUTZUNG DER ADAPTIVEBEE-SOFTWARE UND -DIENSTE DURCH YOUR ODER DER UNMÖGLICHKEIT DER NUTZUNG DER ADAPTIVEBEE-SOFTWARE ODER VON SOFTWARE ODER ANWENDUNGEN DRITTER IN VERBINDUNG MIT DER ADAPTIVEBEE-SOFTWARE ERGEBEN, JEDOCH VERURSACHT WURDEN, UNABHÄNGIG VON DER THEORIE DER HAFTUNG (VERTRAG, UNERLAUBTE HANDLUNG ODER ANDERWEITIG) UND SELBST WENN ADAPTIVEBEE ÜBER DIE MÖGLICHKEIT SOLCHER SCHÄDEN UNTERRICHTET WURDE. EINIGE RECHTSPRECHUNGEN ERLAUBEN KEINE BESCHRÄNKUNG DER HAFTUNG FÜR PERSONENSCHÄDEN, ZUFÄLLIGE SCHÄDEN ODER FOLGESCHÄDEN, SO DASS DIESE BESCHRÄNKUNG MÖGLICHERWEISE NICHT FÜR SIE GILT. In keinem Fall darf die Gesamthaftung von ADAPTIVEBEE Ihnen gegenüber für alle Schäden (mit Ausnahme derjenigen, die nach geltendem Recht in Fällen von Personenschäden erforderlich sind) den Betrag von fünfzig Dollar ($50,00) übersteigen. 12. Bezahlung.
A) ADAPTIVEBEE speichert keine Daten innerhalb des UR Browser-VPN, die eine Beeinträchtigung Ihrer personenbezogenen Daten ermöglichen könnten. Für alle Vorgänge, bei denen es sich um die Speicherung personenbezogener Daten handelt, wie z.B. Zahlungsvorgänge, arbeitet ADAPTIVEBEE mit Drittanbietern zusammen, die die getrennte Speicherung von Daten vornehmen, außerdem verhält sich ADAPTIVEBEE wie ein "Proxy" zwischen Dritten und bemüht sich um die Trennung von Daten, wie Zahlung vs. VPN-Anbieter. B) Zahlungen erfolgen immer im Voraus für die Dienstleistungen von ADAPTIVEBEE. ADAPTIVEBEE ermöglicht derzeit die Zahlung per Kreditkarte und wird in Zukunft zusätzliche verschiedene Zahlungsmethoden wie PayPal, Bitcoin und andere zulassen. Die Abonnementlaufzeit beginnt mit dem Eingang der Zahlung bei ADAPTIVEBEE. Wenn mehrere Benutzer das gleiche Konto verwenden, wird es sofort gesperrt, ohne Rückerstattungsoptionen, da es sich um eine direkte Verletzung dieser Vereinbarung handelt.
E) Rückerstattungspolitik: ADAPTIVEBEE hat eine 10-tägige Geld-zurück-Garantie für Erstkäufe. In Übereinstimmung mit dem französischen Recht, nach dem ADAPTIVEBEE arbeitet, behalten wir uns das Recht vor, die Rückerstattung von Verlängerungskäufen abzulehnen. Der Kunde muss ADAPTIVEBEE innerhalb von 10 Tagen nach der ersten Zahlung per E-Mail oder Live-Chat kontaktieren, damit die Geld-zurück-Garantie gültig ist. H) Betriebszeit des Dienstes: ADAPTIVEBEE zielt darauf ab, die Serververfügbarkeit so hoch wie möglich zu halten. Aktive zahlende Nutzer erhalten zwei Minuten für jede Minute Ausfallzeit, die 0,9% Ausfallzeit pro Kalendermonat übersteigt.
I) Verantwortung: ADAPTIVEBEE ist nicht verantwortlich für Schäden oder Einkommensverluste, die durch die Nutzung unserer Dienste entstehen.
13. Anzeigen.
A) Ein Teil der ADAPTIVEBEE-Software wird durch Werbeeinnahmen unterstützt und kann Werbung und Werbeaktionen anzeigen. 14. Kontrolle von Recht und Teilbarkeit.
Diese Lizenz unterliegt den Gesetzen von France und wird in Übereinstimmung mit diesen ausgelegt, ohne Rücksicht auf oder Anwendung von Regeln oder Prinzipien des Kollisionsrechts. Das Übereinkommen der Vereinten Nationen über Verträge über den internationalen Warenkauf findet keine Anwendung. Sie sind ohne die vorherige schriftliche Zustimmung von ADAPTIVEBEE nicht berechtigt, diese Vereinbarung oder die hierin gewährten Rechte kraft Gesetzes oder anderweitig abzutreten oder zu übertragen, und jeder Versuch Ihrerseits, dies ohne diese Zustimmung zu tun, ist nichtig. Sofern nicht ausdrücklich in dieser Lizenz festgelegt, bleibt die Ausübung eines ihrer Rechtsmittel im Rahmen dieser Lizenz durch eine der Parteien unbeschadet ihrer anderen Rechtsmittel im Rahmen dieser Vereinbarung oder anderweitig. Alle Mitteilungen oder andere Mitteilungen, die im Rahmen dieser Vereinbarung zulässig oder erforderlich sind, werden Ihnen auf eine der folgenden Arten zur Verfügung gestellt: durch Veröffentlichung auf der ADAPTIVEBEE-Website, per E-Mail oder durch Benachrichtigungen in der ADAPTIVEBEE-Software. Diese Lizenz stellt die gesamte Vereinbarung zwischen Ihnen und ADAPTIVEBEE in Bezug auf die ADAPTIVEBEE-Software dar (mit Ausnahme aller Dienstleistungen, die ADAPTIVEBEE Ihnen im Rahmen einer separaten schriftlichen Vereinbarung zur Verfügung stellt) und ersetzt alle früheren oder gleichzeitigen Absprachen in Bezug auf diesen Gegenstand. Keine Änderung oder Modifikation dieser Lizenz ist bindend, es sei denn, sie ist schriftlich und von ADAPTIVEBEE unterzeichnet. Jede Übersetzung dieser Lizenz wird für lokale Anforderungen erstellt, und im Falle eines Streits zwischen der englischen und einer nicht-englischen Version gilt die englische Version dieser Lizenz, soweit sie nicht durch das lokale Recht in Ihrer Gerichtsbarkeit verboten ist. Wenn ein Teil dieser Bedingungen als ungültig und nicht durchsetzbar befunden wird, hat dies keinen Einfluss auf die Gültigkeit des Restbetrags der Bedingungen, die gemäß ihren Bedingungen gültig und durchsetzbar bleiben. Keine Agentur, Partnerschaft, Joint Venture, Mitarbeiter-Arbeitnehmer- oder Franchisegeber-Franchisenehmer-Beziehung ist durch diese Bedingungen beabsichtigt oder geschaffen. Sie sind nicht berechtigt, diese Bedingungen oder Rechte oder Pflichten aufgrund von Gesetzen oder anderweitigen Bestimmungen abzutreten oder zu übertragen. Das Unternehmen behält sich ausdrücklich das Recht vor, diese Bedingungen abzutreten oder zu übertragen und alle seine Verpflichtungen aus diesem Vertrag nach eigenem Ermessen zu übertragen. Überschriften dienen nur zu Referenzzwecken und schränken den Umfang oder die Reichweite eines solchen Abschnitts nicht ein. Die Unterlassung des Unternehmens, in Bezug auf eine Verletzung durch Sie oder andere zu handeln, verzichtet nicht auf unser Recht, in Bezug auf nachfolgende oder ähnliche Verletzungen zu handeln.
Für alle Streitigkeiten, die Sie mit uns haben, erklären Sie sich damit einverstanden, den Streit mit uns zunächst informell beizulegen und zu versuchen. Wenn wir nicht in der Lage waren, den Streit mit Ihnen formlos beizulegen, erklären wir uns alle mit diesen Bedingungen einverstanden, sofern gesetzlich nicht anders vorgeschrieben, alle Ansprüche, Streitigkeiten oder Kontroversen zu lösen, die sich aus oder im Zusammenhang mit oder in Bezug auf diese Bedingungen ergeben. ALLE ANSPRÜCHE MÜSSEN IN INDIVIDUELLER EIGENSCHAFT DER PARTEIEN UND NICHT ALS KLÄGER ODER KLASSENMITGLIED IN EINEM PURPORTIERTEN KLASSEN- ODER VERTRETUNGSVERFAHREN GELTEND GEMACHT WERDEN, UND DER SCHIEDSRICHTER DARF NICHT MEHR ALS DIE ANSPRÜCHE EINER PERSON KONSOLIDIEREN. SIE STIMMEN ZU, DASS SIE UND WIR DURCH DIE EINGABE DIESER BEDINGUNGEN AUF DAS RECHT AUF EINE VERHANDLUNG DURCH JURY ODER AUF DIE TEILNAHME AN EINER KLAGE VERZICHTEN.
16. Bestätigungen und Bedingungen von Drittanbietern.
A) Teile der ADAPTIVEBEE-Software können Dienste, Feeds oder Inhalte von Drittanbietern integrieren oder mit diesen bereitgestellt werden, einschließlich, aber nicht beschränkt auf Links, Artikel, Grafiken, Werbung, Videos, Audios, Nachrichten oder andere Materialien, die von Drittanbietern bereitgestellt werden ("Drittanbieterinhalte"). Mit der Nutzung von UR erklären Sie sich auch mit diesen Bedingungen Dritter einverstanden.
C) Sofern nicht ausdrücklich etwas anderes angegeben ist, besteht keine Verbindung zwischen ADAPTIVEBEE und anderen Drittanbietern.
17. Zusätzliche Bedingungen für spezifische Funktionen und Erweiterungen für die ADAPTIVEBEE-Software.
A) Die Bedingungen in diesem Abschnitt gelten, wenn Sie Funktionen oder Erweiterungen auf Ihrer Kopie der ADAPTIVEBEE-Software installieren. Erweiterungen sind kleine Softwareprogramme, die von ADAPTIVEBEE oder Dritten entwickelt wurden und die die Funktionalität der ADAPTIVEBEE-Software verändern und erweitern können.
