Ashish Ranjag Pandey was alleged by the prosecution part of the mob which ran havoc leading to the Gulberg massacre and was recorded as absconding in the original previous chargesheets.
The courtβs reasoning was based on its observation that as far as criminal appeals are concerned, it is not necessary to include every ground of argument in the petition, thereby allowing the said amendments to be argued by the petitioners during the final hearing.
Citing various judgments of the Supreme Court, defence lawyers of the Gulberg convicts asked the court to consider all mitigating factors before pronouncing the judgment.
Pleading for maximum punishment, the prosecution said capital punishment could be considered by the court or the convicts be sent to jail and ordered to remain there till their last breath.
