The West Bengal health department's advisory follows repeated complaints of violations of guidelines under the Protection of Children from Sexual Offences (Pocso) Act in state-run hospitals.
The court went on to specify that for disbursal of compensation, documents such as the survivor’s Aadhaar card and birth certificate would suffice as proof of the child victim’s identity.
As per the prosecution’s case, the 21-year-old accused, who used to work in a medical store located on the premises where the minor girl was working as labourer, had befriended her and then kidnapped her after promising her marriage.

This was based on two cases heard by the High Court. In the first case, one Aleem Pasha had approached the court for bail after being booked by K R Puram police in Bengaluru as he had married and impregnated his 17-year-old wife.
In a complaint to the police, the minor girl’s father said the accused had been blackmailing her and forcing her to meet him after threatening to share her nude photos on social media.
The HC said this while hearing a petition challenging a circular issued by former Mumbai Police commissioner Sanjay Pandey on June 6 that said that approval of the DCP was needed before registering FIRs under the Protection of Children from Sexual Offences (POCSO) Act and in cases of molestation.
The case was registered under sections of 376(2)(G) (gangrape), 302 (murder), 204 (tampering with evidence) of the Indian Penal Code and relevant sections of the Protection of Children from Sexual Offences (POCSO) Act.
