Although the headquarters is indicated as coordinating and deliberative, but the regulation on it says that its decisions are binding on "federal executive bodies, executive bodies of the constituent entities of the Russian Federation, other state bodies, local self-government bodies and organizations in respect of which such decisions have been made." The composition of the headquarters is approved by the President of the Russian Federation and is under the control of his administration. At the same time, in addition to representatives of departments such as, Security Council,, Federation Council,, FSB, FSTEC Ministry of Defence RAS Ministry of Digital Development, Russian Foreign Ministry and others, it is planned to include the heads of organizations operating in the field of AI technologies.

However, the use of various AI technologies in public administration is not always an obvious task. And it is important here to solve not only technical issues, but also legal and moral ones.

In the public sector, the use of AI is not always obvious, - Lyudmila Bogatyreva, head of the IT division of the Polilog agency, shared her doubts with TAdviser. - Therefore, the creation of an interdepartmental commission allows, on the one hand, to determine priority scenarios for the use of AI, on the other hand, to avoid situations when different departments separately create similar solutions "from scratch." Joining forces makes it possible to immediately create those solutions that can be reused in other authorities.

In a press release Ministry of Digital Development[2] on the work on the formation of an interdepartmental commission, it is said that the headquarters will ensure the use[3] AI in key sectors of the economy, public administration, social sphere, as well as prompt resolution of issues on the creation and implementation of AI. The main tasks are as follows:

  • Ensuring coordinated actions of government agencies and interested organizations to implement state policy in the field of AI;
  • Consideration of key issues of implementation of AI technologies;
  • Develop and submit proposals to improve the efficiency of work on the creation and implementation of AI;
  • Coordination of activities on the development and implementation of trusted AI technologies and information security, increasing computing power for AI, increasing the level of competence in this area.

However, in the text of the document, more such tasks are listed - 16. Unfortunately, the project, although the approval of the composition of the headquarters was announced, does not give a specific list.

According to Vladislav Shelepov, threat analyst at GSOC Gazinformservice, there are several key tasks that will need to be solved with the help of the headquarters. The interdepartmental commission should approve the national plan for the introduction of AI into the economy and public administration, remove administrative barriers and ensure priority demand for domestic AI models. Also in focus should be the development of infrastructure and coordination of law enforcement agencies in the field of AI.

The main task, the solution of which, according to the expert, the market has long been waiting for is access to data. It is assumed that the headquarters will be empowered to oblige departments to transfer their datasets for training Russian neural networks. In particular, paragraph "m" is devoted to this problem, which involves coordination, with the help of the headquarters, of the activities of federal executive bodies to collect and provide data, including the preparation of buildings (sets) of verified data necessary to train AI models taking into account Russian cultural and historical values, determine the procedure for accessing data and those responsible for their updating.

At the same time, Alexei Mironov, a leading specialist at Stakhanovets, hopes that the key tasks will be to develop uniform data security standards for model training, eliminate legal conflicts in matters of responsibility for AI decisions and form transparent criteria for public procurement of intelligent systems in order to exclude the chaotic introduction of unverified solutions.

Excessive centralization can, in his opinion, limit the flexibility and innovation of the market, which will negatively affect the quality of projects and products. No less important is the question of personnel - there are few high-quality specialists in the field of AI in Russia. If we assume that the public sector wants to unite such experts within its structures, then the lack of experts on the open market may negatively affect the development of the commercial segment of the AI market.

FSTEC and FSB will issue certificates for AI systems for critical facilities in Russia

  • High - AI is used at critical information infrastructure (CII) facilities;
  • Critical - the system threatens the life or health of people and the security of the state or makes decisions without human intervention.

As part of the new initiative, it is planned to form the National Center for Artificial Intelligence in the field of public administration under the government: this structure will determine the level of criticality of a particular system. The center will also have to form a register of products allowed for use at CII facilities. At the same time, Ministry of Digital Development will create a special testing ground for testing AI systems for compliance with new requirements.

In addition, the bill provides for a ban on the use within the framework of CII of those AI systems, the rights to which belong to foreign persons. It is assumed that this will provide technological sovereignty and protection against the risks of transferring valuable data to special services and intelligence of unfriendly countries.[4]

Russia is taking a hybrid approach to regulating artificial intelligence. Most regulations are stimulating, but there are point restrictions and self-regulatory mechanisms. And the fines are prohibitive. Therefore, all companies are trying to move somewhere outside the European Union so as not to expose themselves to such risks, - said German Gref.


And the third type, to which Russia can be attributed, is hybrid regulation. In the same wing is the United States. Here, on the one hand, there is regulation, and on the other, there is support and an attempt not to run forward and create barriers to the development of new technology.

In general, the role of the state in the development of AI is critical, notes German Gref. The United States is also doing a lot to develop the AI sphere. For example, many amendments were adopted in terms of tax legislation. The strategy also provides for an increase in the level of confidence of citizens in artificial intelligence technologies to 80% (from 55% in 2022). By 2030, organizations will have to invest at least ₽850 billion on the introduction and use of AI technologies.[10]

One of the draft decisions of the Ministry of Economy changes the rules for amending the EPR - they, as the Kommersant newspaper notes, can be prepared by an authorized body or regulator on their own initiative, on behalf of the president or government, as well as on the proposals of companies. The second project is designed to optimize the procedures for submitting reports of EPR subjects on their activities. The third document gives the Ministry of Economy an additional basis for suspending the status of the subject of the EPR - according to the conclusion of the commission of the department, created to establish the circumstances in which harm was caused as a result of the use of decisions using artificial intelligence.
