Une importation parallèle est un produit non contrefaçon importé d'un autre pays sans l'autorisation du propriétaire de propriété intellectuelle. Les importations parallèles sont souvent appelées produits gris et sont impliquées dans les questions du commerce international et de la propriété intellectuelle. L'importation parallèle repose sur la notion d'épuisement des droits de propriété intellectuelle: selon ce concept, lorsque le produit est lancé sur le marché dans une juridiction particulière, l'importation parallèle est autorisée à tous les résidents de l'état concerné. Certains pays le permettent, d'autres ne le font pas. L'importation parallèle de produits pharmaceutiques réduit le prix des produits pharmaceutiques en introduisant une concurrence; L'accord sur les ADPIC à l'article 6 stipule que cette pratique ne peut être contestée dans le cadre du système de règlement des différends de l'OMC et, de ce fait, est effectivement une question de discrétion nationale. La pratique de l'importation parallèle est souvent préconisée dans le cas des logiciels, de la musique, des textes imprimés et des produits électroniques, et se présente pour plusieurs raisons: ▪ Différentes versions d'un produit sont commercialisées sur différents marchés. Parallel imports are often referred to as grey product, and are implicated in issues of international trade, and intellectual property. Parallel importing is based on concept of exhaustion of intellectual property rights: according to this concept, when the product is first launched on the market in a particular jurisdiction, parallel importation is authorized to all residents in the state in question. Some countries allow this, others do not. Parallel importing of pharmaceuticals reduces price of pharmaceuticals by introducing competition; TRIPS agreement in Article 6 states that this practice cannot be challenged under the WTO dispute settlement system and so is effectively a matter of national discretion. The practice of parallel importing is often advocated in the case of software, music, printed texts and electronic products, and occurs for several reasons: ▪ Different versions of a product are produced for sale in different markets.
