No medical records have been submitted by the insurance company to show that the man was suffering from any disease on or before the insured date, the consumer commission noted.

The National Consumer Disputes Redressal Commission was hearing a revision plea filed by an insurance company challenging consumer forum orders directing it to pay Rs 5 lakh to a policyholder.
The dispute dates back to October 2012, when the complainants were approached by representatives of the developer regarding a flat located in Sector 102/102A, Gurgaon.
The PricewaterhouseCoopers employee travelled to the US on July 10, 2017, but developed acute pancreatitis with severe complications and was hospitalised for over 50 days following a cardiac arrest.
The professor filed a complaint allegedly on realising that the amount had been withdrawn from his SBI account in Bengaluru through unauthorised transactions, the consumer forum noted.
Noting that the woman was only 56 years old at the time of the incident and that loss of a family member is irreparable, the consumer commission said the complainants “deserved to be heavily compensated”.
The formal sale agreement of the flat was executed in July 2018. The complainants alleged that despite an offer of possession being issued in April 2022, the project was incomplete.
The Supreme Court ruling is limited to clarifying that the case can continue, and that any compensation, if awarded, can be recovered from the estate of the deceased doctor, not from his legal heirs personally.
